Terms and Conditions for Lucky Driver

PLEASE READ AND ACCEPT OUR TERMS AND CONDITIONS CAREFULLY BEFORE USING THE LUCKY TO GO APP ON BOTH MOBILE AND WEB BASED PLATFORMS (THE “SERVICES”) OPERATED BY LTG TECHNOLOGIES LTD. (“US”, “WE” OR “OUR’ ).

Your access and use of the app constitutes your agreement to the terms and conditions which establishes a contractual relationship between you and LTG technologies Ltd..If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. LTG Technologies Ltd reserves the right to terminate the agreement in case of any non compliance by temporary suspension of access to the app.

Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.

LTG Technologies Ltd may amend this agreement from time to time. Users shall be notified of the amendment wherein which the amendments will be effective upon LTGs posting of the updated agreement in the platform. Your continued access of the platform is automatically considered as consent to the agreement.

You acknowledge that LTG Technologies Ltd does not function as a transportation service provider or own any vehicles for transportation and all transportation services are provided by independent third party contractors who are not employed by LTG technologies Ltd.

LTG platform may be subject to access to third party content which includes advertising that LTG does not control. Your use of the service acknowledges the different terms of use and privacy policies that are aligned with your use of third party services and content. LTG does not endorse nor is it responsible for the services and content of third party providers. The third party providers are in turn not responsible for the provision and support of the LTG platform in any manner. Your access to the LTG platform using these services or applications is subject to terms set forth in the applicable third party beneficiary’s terms of service.

1. PROMOTIONS

LTG will be from time to time sending the users or potential users available promotions of the time. The promotions are in no relation to the agreement you have with LTG . Promotions will be available with codes saying “ PROMO CODES”. LTG reserves the right to withhold or deduct credits obtained through the promotion in the event of the receipt of the credit obtained through the code was in error or through fraudulent means or in violation of the terms of the agreement.

You agree that the promo codes would only be used for the intended purpose and will not be duplicated, sold or transferred in any manner or be made available to the general public, unless permitted by LTG technologies Ltd. They are also not valid for cash and may expire prior to your use.

As part of your account, LTG may provide you a referral code which is allowed to distribute among friends, family or other persons to become a new user or a new driver. From time to time, incentives in the form of discounts will also be made available and LTG sets the amount, incentive type, terms and requirements in its sole discretion. You may not sell, trade or barter your codes as well as from advertising your codes in any public channels which includes all social media channels. LTG reserves the right to invalidate or disable the code any time in its own sole discretion.

2. RESTRICTIONS

With respect to your use of LTG platform and your enrollment as a driver with LTG technologies Ltd, you agree that you will not:

1. Impersonate any person or entity
2. Stalk, threaten or harass any person
3. Carry any illegal substances (marijuana, drugs of any kind) and alcohol
4. Violate any rule, law, ordinances or regulation of any kind with respect to all the governing boards and the company LTG technologies Ltd
5. Post or interact with the platform or LTG technologies Ltd in a manner which is false or misleading, defamatory, abusive or obscene in any manner, which is offensive, threatening or illegal
6. Use the LTG platform in any way that could disrupt the services or rights of any third party, including but not limited to: intellectual property rights, copyright, patent, trademark, or rights of publicity or privacy
7. Transfer or sell your account to anyone
8. Discriminate against anyone on the basis of race, religion, country of origin, gender, sexuality, physical or mental disability, medical condition, age, marital status
9. Cause any third party to engage in the restricted activities mentioned above.
10. Mention the Second name (Surname) to the riders.

3. CONDITIONS

1. LTG Technologies Ltd requires all drivers to have the necessary requirements and qualifications ready before registering themselves.
2. The driver must adhere to the terms of the agreement and provide adequate services to the user accordingly.
3. LTG Technologies Ltd should be notified of any updates made to your drivers license and vehicle insurance. You will receive the first notification of update 30 days before the expiration of the above said documents, the second 14 days before expiration. If no action has been made by uploading your updated document, your account will be temporarily suspended 5 days before the expiry date.
4. The driver would require to notify LTG Technologies Ltd of any changes to their address and their commercial vehicle inspection report ( this should be done within one year or 40,000Km of the odometer reading mentioned in the first commercial vehicle inspection report)

4. RESPONSIBILITIES OF THE DRIVER

1. Always ensure usage of only one vehicle that was entered during registration while providing services for LTG technologies LTD
2. Adheres to all policies and rules put forward by the service as well as other regulatory bodies. These may include, maintaining a professional attitude and keeping the car clean according to standard procedures.
3. Vehicle Insurance is the driver’s sole responsibility.
4. Comply with all road safety laws when operating the vehicle.
5. All of the driver registration requirements must be followed.
6. Items left in the vehicle must be reported immediately to the concerned authorities.
7. Must take full responsibility for any losses or damage to the vehicle. We, at LTG, care for the driver’s vehicle. If a rider made a mess in your vehicle that requires significant cleaning/repair, please let us know immediately. In some cases, we may be able to charge the rider and issue you a cleaning fee. To request a cleaning fee, please submit a photo of the mess along with the quote for the cleaning service within 1 business day of the trip. A quote must have the following details to be valid: a. The date of the quotation and b. The name of the cleaning service Please note that for moderate messes - We will not charge riders for any mess caused by water, or for items that can be thrown away or wiped up quickly. Cleaning Fee Guide — Fee assessments vary by type of mess and severity. Based on the photos, quote, and a receipt provided, you may be eligible to receive payments up to the receipt amount.
8. Ensure that you use only one vehicle, entered during registration, while providing services for LTG Technologies Ltd.

This agreement constitutes the understanding between LTG technologies Ltd and the driver. Once the agreement is signed, no changes or waiver to the agreement can be done. By registering for LTG Technologies Ltd, you agree to all terms and conditions listed on the agreement.

Your use of the LTG platform requires you to submit your current and updated information which includes your personal information such as name, email and phone number. Your failure to maintain accurate and complete information will result in limited access to the platform as well as the option to opt out of marketing preferences.

5. COMPANY OBLIGATIONS

As per PTB regulations, we at LTG Technologies Ltd are required to provide driver’s information every three months which would include your license information, criminal record check and drivers record check. We are also required to update them regularly on the number of trips done and the kilometers travelled, the total hours worked, and the total amount earned during that duration. The criminal record check certificate of the driver will be put up in the app and will be having all the required information.

LTG TECHNOLOGIES LTD. is required to meet the TNS evidence of authority as follows. We will be required to present them on the app for law enforcement.

1. TNS Licensee name
2. Driver full name and passport sized photograph
3. Expiry date of criminal record check
4. Attestation that verifies requirements have been met
5. Vehicle make/model/year and license plate number
6. BC NSC number

LTG Technologies Ltd is not responsible for any losses or damages borne on the vehicle. LTG Technologies Ltd would offer a blanket insurance coverage for every ride the driver does, which gets activated from the moment the driver accepts the ride till the ride has been completed. The blanket coverage provides coverage for Accident Benefits and up to $1,000,000 third party liability. When he is not transporting passengers, he would be under his personal basic insurance coverage.

6. RIDE HAILING DRIVER OBLIGATIONS

The Driver will adhere to the following regulations imposed in accordance with the Passenger transportation board and LTG Technologies for use of services within the framework of the Transportation Network Services industry.

1. Ensure that the license and record checks are up to date and current.
2. Comply with all safety requirements and other conditions of their Driver accreditation in accordance with the
   Passenger Transportation Board
   ICBC
   Passenger Transportation Act
3. For ride hailing drivers, the age of their vehicle must be within 9 years + 1 month when operating under TNS authorisations. This is to ensure vehicles are incorporating most current vehicle safety and fuel efficiency measures.
4. Physical copies of the drivers record check will always be displayed in a clearly visible place of the motor vehicle.

7. CANCELLATION CHARGES

If you accept and cancel the ride, there will be a base cancellation charge of $2.50 added to your account. For further information, refer to the driver’s manual.

8. WHAT MUST BE CARRIED INSIDE THE VECHILE

1. A copy of the licence, and the vehicle identification certificate applicable to that motor vehicle if one is issued, must be carried in that motor vehicle when the motor vehicle is being operated as a commercial passenger vehicle, and
2. No other vehicle identification certificate may be carried in the vehicle.

Note: If a driver has been deemed ineligible to drive based on the record check agreements, drivers can appeal to the Passenger Transportation Branch Registrar within 30 days of receiving the notice.
